Todd County Board of Commissioners
Settlement agreement with Mannings approved

At long last a dispute which arose originally in 2005 between Grey Eagle Township and Thomas and Cynthia Manning and Todd County was put to rest after a closed session with Attorney Tim Sime at the May 6 board meeting. The dispute with the township had actually been settled on November 5, 2007, but the dispute with the Mannings over the construction of a residence on property adjacent to Mound Lake was still active. The construction had been halted. At this time they had nearly completed excavation and the land clearing activities on the property and had completed or nearly completed construction of the residenceís foundation and framing of the first floor. There was discussion about whether the excavation and removal of the existing structure and foundation would increase erosion or cause other concerns relating to potential impacts to the shoreland and Mound Lake. The county and the Mannings have prepared and continue to prepare plans designed to limit the potential impacts to the shoreland and the lake while allowing the residence to be completed to avoid additional excavation within the bluff and shoreland impact areas. The Mannings have agreed to revise their construction plans and complete restoration plans. They will also compensate the county for its fees, costs and damages incurred in bringing the enforcement action. This amounts to $60,000 and will be used as a contribution to the countyís parks and trails department. The county staff (planning and zoning) will approve any blueprints and building plans, erosion control plans, landscaping and re-vegetation plans, post-construction drainage control plans, Individual Sewage Treatment System plans and any other applicable plans to be provided to and approved by the county in accordance with the settlement agreement prior to issuing any building permits.
Sheriffís Department
Approved accepting a boat and water grant in the amount of $5611.
Environment and Land
Resource Management
Approved the department to enter into a contract for
legal services with the Rinke Noonan Law Firm at a cost of $500 a month.
This will be similar to the general retainer the county has with Kurt
Deter for ditch consultation.
ELRM Director Andrew Dahlgren said that citations would still go through the county attorney. Tim Sime from that law office, said that this would be a month to month contract at the boardís discretion and could be ended at any time. Commissioner David Kircher said that while he thought this was probably a good way to spend money, he felt that they needed to look at spending habits and that just because something is budgeted doesnít mean it has to be spent.
Public Health
Approved replacing carpet in the public health offices.
The carpet was installed in 1990. Three estimates were received. The
lowest was from Hennen Floorcovering, Inc. of Freeport for $13,630. The
estimate includes removal and disposal of the old carpet and full
installation of the new carpet with baseboards and metal doorway trim
edgings.
Approved the appointments to the Todd County Public Health Advisory Committee. These appointees are: Dr. Steven Brunswig, DVM; Steve Commerford, career corrections agent youth worker for Todd County Community Corrections and Judy Denny, Long Prairie/Grey Eagle Schools Family Outreach Worker.
Ditch Inspector
Ditch Inspector Emma Larson said that complaints are
still being received about work that was done on Ditch 15, mostly about
unleveled spoils. She brought a resolution requesting that all
complaints regarding the cleanout be received by her by May 30, 2008.
This was approved.
Ag Society/Grandstand Bids
Delvin Durheim brought some information to the board
about fencing around the top of the grandstand building at the
fairgrounds as well as other repairs needed to the roof.
He was directed to come back to the board on the May 20 meeting with a resolution and costs. He said that some of the fencing work could be done by the fair board members. There is money in an account from hail damage from several years ago that will help pay for the roof repair.
